 UPDATE ON LSV TAX CREDIT APPEALS:  May 18, 2011

In early March, two Administrative Law Judges ruled that the Tomberlin and Ruff & Tuff models of LSVs qualified for the Oklahoma State Income Tax Credit.  Shortly after the ruling, the Oklahoma Tax Commission appealed the judges' rulings...to the OTC Commissioners themselves. 

Upon reviewing the cases, the OTC Commissioners decided the Ruff & Tuff models qualified for the credit and the Tomberlin models did not qualify for the tax credit.  This decision was despite the fact that, among other things, both makes are engineered as street legal LSVs and meet the Federal Government's standards for LSVs and qualified for the Federal tax credit.  The owners of Ada Electric Cars and GKU will continue to pursue justice.

Ada Electric Cars customers:           MORE GREAT NEWS!

 

Last week, a second OTC Administrative Law Judge issued his ruling, conclusions and recommendations on Ruff ‘N Tuff LSV’s.

 

His Conclusion:

 

Ruff ‘N Tuff Line of LSV’s meets the definition of “qualified electric motor vehicle property” and qualifies for the Credit provided by the Statute.

 

His Recommendation:

 

Based upon the facts and circumstances of this case that the protest to the denial of the “Electric Car Income Tax Credit” for Ruff ‘N Tuff (model) should be granted.

 

We are pleased to report another victory for our customers and for taxpayers across Oklahoma.   Again, we continue to be thankful to our customers for supporting us in this battle and to Mr. Riffel and his team for a fine job of representing us, our customers, and other honest hardworking taxpayers across this great state.

 

Now one District Judge and two OTC Administrative Law Judges have ALL ruled in favor of the Oklahoma taxpayers.  Score:         Taxpayers       3

Hearings are still pending for Stealth, Bad Boy Buggies, and American Custom Cars.  I would hope the OTC is getting the clear message that they were out of line and that they are not permitted to change the law.

All Around Electric Vehicles (AAEV) is a new company that is owned by Chris Bastien.  All Around Electric Vehicles is NOT affiliated with Ada Electric Cars LLC.  Ada Electric Cars LLC is not affiliated with and has no ownership interest in AAEV.  However, we do endorse AAEV as prior to his decision to open a completely new company and prior to AEC being forced to close due to the actions of the OTC, Chris was our company General Manager and did a fine job for our customers and for us as a whole.

 

If you or anyone you know is interested in a new or used low-speed-vehicle, or other electric vehicles we encourage you to call AAEV.  If you want NON-WARRANTY accessories and/or repairs for your current electric vehicle we encourage you to call AAEV.  If you need warranty work on your Stealth, AAEV is the state distributor and a dealer, and you should call them.  If there is another service location for Stealth that is more appropriate, Chris can direct you there.

 

If you are looking for warranty work on your Tomberlin vehicle, please see our posting on our website that identifies other authorized Tomberlin dealers who can service your warranty issues.  AAEV is capable and willing to assist with Tomberlin service work; they have the knowledge and ability, but they are not an “authorized” service center and therefore would require payment for parts when ordered and labor when the vehicle is picked up.

 

For those inquiring about AEC closing (reason: OTC ran us out of business), any AEC obligations (AEC owners will still stand behind them), AEC’s commitment to FIGHT (we are still leading the charge, and will continue to do so), status of hearing decision (pending, overdue, expected anytime):  we addressed these issues in recent emails, and posted the information on our website. We will check our email periodically at aec@adaelectriccars.com but we have no additional information to offer at this time, so please be patient as we fight for your rights.   We will update our website and make contact by email as new information becomes available.

 

Please do not call AAEV for information or updates as they do not have any additional information to give you.

 

We regret the entire set of unfortunate events that have been the direct result of the unethical and illegal actions of the OTC.  This is not how we envisioned our future, but nearly 1 ½ years has passed since the OTC killed our sales and destroyed our business.  We simply could not justify the monthly expenses of running the business while sales were virtually shut down.

 

We will continue to pursue justice on behalf of our customers and all honest, hardworking Oklahoma taxpayers who followed the rules and are being shafted by the OTC!  Thank you for your business and your patience as we work toward a conclusion which we believe (if justice is done) will be in favor of the taxpayers.  We do NOT see any way the OTC can get away with breaking the statutes and dishonoring tax credits for taxpayers who purchased some models, when at the same time they have honored tax credits on other models that are virtually the same!

Ada Electric Cars opened in fall 2008 after careful research on the tax credits offered in Oklahoma for the purchase of electric vehicles.  Prior to opening we received verbal and written confirmation from the Oklahoma Tax Commission that the tax credits applied to low-speed vehicles.

 

In September 2009 the OTC pulled a fast one on us, other dealers, and thousands of honest hardworking Oklahoma taxpayers in their attempt to change the rules by creating an administrative interpretation that was contrary to the existing decade old law, contrary to the verbal and written confirmations that they had previously rendered, and contrary to the precedent already in place.

 

Then, for some completely unknown reason (likely reason was to save tax credit money), the OTC began denying the tax credit on some models while honoring the tax credits on other models that are virtually the same?  Go figure?  The original Garfield County judge saw through their bologna, and now it is in the hands of an OTC administrative hearing judge to do the same.  There are numerous reason why the final outcome should be in favor of the taxpayers, and we hope to have the decision soon.

 

Ada Electric Cars held on as long as possible and we hope we have provided all of our customers with the products and services they wanted and needed to date.  Unfortunately as a direct result of the illegal and unethical actions of the OTC we are no longer able to continue as a going concern.

 

We will continue to fight for your rights and for the proper recognition of the tax credits that you deserve.
